Types of Representatives for a Disability Appeal


Disability Attorneys

A Social Security Disability attorney is often the most qualified type of representative. They are experienced in navigating the Social Security Administration (SSA) system, understand complex medical and legal issues, and can represent you at all levels of appeal.


Benefits of hiring an attorney:

  • They can collect and submit medical evidence.
  • They know how to argue your case effectively before an Administrative Law Judge (ALJ).
  • They only get paid if you win your case (typically 25% of your back pay, up to a set limit).


Non-Attorney Representatives

These are individuals who are not lawyers but are qualified and authorized by the SSA to represent claimants. Many are trained specifically in disability claims and may work for advocacy organizations.


They can:

  • Help with paperwork and deadlines.
  • Represent you during hearings.
  • Provide valuable advice, especially if they’re experienced.


Family Members or Friends

You can appoint a trusted friend or relative to represent you. However, the SSA may require them to show they are capable of handling the responsibilities.


Important to note:

  • They must be approved by the SSA.
  • They may not have the same level of knowledge or effectiveness as a trained representative.


How to Appoint a Representative

To make it official, you must complete Form SSA-1696 (Appointment of Representative) and submit it to the SSA. This form authorizes your chosen representative to act on your behalf and access your records.
