Stages of the Disability Appeal Process
There are four main levels in the SSA’s appeals process, each with its own timeline:
Reconsideration
- Timeline: Around 1 to 3 months
- After your initial application is denied, the first step is to request a reconsideration. During this stage, someone who was not involved in the original decision will review your case.
- You must file this request within 60 days of receiving the denial letter.
Hearing Before an Administrative Law Judge (ALJ)
- Timeline: Usually 6 months to 1 year, though it can take longer depending on your location.
- If reconsideration is denied, you can request a hearing before an ALJ. This is often the most important stage of the appeal.
- You’ll receive notice of the hearing at least 75 days in advance.
Appeals Council Review
- Timeline: Around 6 months to 1 year
- If the ALJ denies your claim, you can ask the Appeals Council to review the decision. The Council may deny your request, send your case back to the ALJ, or issue a new decision.
Federal Court Review
- Timeline: Can take 1 year or more
- If the Appeals Council denies your claim or upholds the ALJ’s decision, your final option is to file a lawsuit in federal court. This step requires legal expertise and can be a lengthy process.
