If your Social Security Disability claim was denied, you’re not alone—and you have the right to appeal. Understanding the timeline for a disability appeal can help you manage your expectations and take the right steps promptly. The process can take several months to years, depending on where you are in the appeals process and how quickly you respond to requests from the Social Security Administration (SSA).

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Stages of the Disability Appeal Process

There are four main levels in the SSA’s appeals process, each with its own timeline:

Reconsideration
  • Timeline: Around 1 to 3 months
  • After your initial application is denied, the first step is to request a reconsideration. During this stage, someone who was not involved in the original decision will review your case.
  • You must file this request within 60 days of receiving the denial letter.

Hearing Before an Administrative Law Judge (ALJ)

  • Timeline: Usually 6 months to 1 year, though it can take longer depending on your location.
  • If reconsideration is denied, you can request a hearing before an ALJ. This is often the most important stage of the appeal.
  • You’ll receive notice of the hearing at least 75 days in advance.

Appeals Council Review

  • Timeline: Around 6 months to 1 year
  • If the ALJ denies your claim, you can ask the Appeals Council to review the decision. The Council may deny your request, send your case back to the ALJ, or issue a new decision.

Federal Court Review

  • Timeline: Can take 1 year or more
  • If the Appeals Council denies your claim or upholds the ALJ’s decision, your final option is to file a lawsuit in federal court. This step requires legal expertise and can be a lengthy process.

Factors That Can Affect the Timeline
  • Backlog at SSA offices: High caseloads can slow down your appeal, especially at the hearing stage.
  • Missing documentation: Delays often happen when the SSA needs more medical records or information.
  • How quickly you respond: Promptly providing requested documents or attending appointments helps keep your case moving.
