Disability Appeal Success Rates by Stage
The appeal process has four main levels, each with its own likelihood of approval:
- Reconsideration
- Success Rate: Roughly 13%–15%
- Most reconsiderations result in another denial, as this step is usually a paper review by someone new but still within the SSA.
- Administrative Law Judge (ALJ) Hearing
- Success Rate: Approximately 45%–55%
- This is where many applicants succeed. Presenting your case in person and submitting new medical evidence can significantly improve your chances.
- Appeals Council Review
- Success Rate: Around 10%–20%
- The Appeals Council can deny review, uphold the ALJ’s decision, or remand the case for another hearing. Only a small percentage are approved outright.
- Federal Court Review
- Success Rate: Roughly 2%–5% for outright approvals
- While federal courts rarely grant benefits directly, they can remand (send back) the case for further review, giving you another opportunity to present your claim.
