How many levels of appeal are there?

If your Social Security Disability claim is denied, you have the right to appeal—and the process includes four levels of appeal, each with its own procedures and deadlines. Understanding these levels can help you stay on track and increase your chances of getting approved.

Reconsideration

This is the first level of appeal after your initial application is denied. A different SSA reviewer will take a fresh look at your case, including any new medical evidence you provide.


  • Deadline: Within 60 days of receiving your denial letter.
  • Tips: Be sure to submit updated records and clarify any misunderstandings from your initial application.


Hearing Before an Administrative Law Judge (ALJ)

If reconsideration is denied, you can request a hearing before a judge who will evaluate your case in person or via video conference.


  • Deadline: Request within 60 days after your reconsideration denial.
  • Why it matters: This is often where many applicants are finally approved, especially with strong documentation and testimony.


Appeals Council Review

If you disagree with the judge’s decision, you can ask the SSA’s Appeals Council to review the case. The Council may:


  • Approve your claim
  • Deny the request
  • Send it back to the ALJ for another hearing
  • Deadline: Within 60 days of the hearing decision.


Federal Court Review

As a final step, you can file a lawsuit in federal district court if the Appeals Council denies your request or upholds a denial.


  • Deadline: File within 60 days of the Appeals Council’s decision.
  • Note: This step is best handled with the help of an attorney due to its complexity.
