When Can You Submit New Evidence?


Reconsideration Stage

At this first level of appeal, the Social Security Administration (SSA) takes a second look at your application. You can submit:


  • New medical records
  • Updated test results
  • Doctor’s opinions or letters
  • Any information not included in your initial claim


Hearing with an Administrative Law Judge (ALJ)

This is often the best opportunity to submit new evidence. The ALJ will consider:


  • Medical records created after your initial decision
  • New diagnoses or worsening symptoms
  • A completed Residual Functional Capacity (RFC) form
  • Witness statements or vocational expert reports


Appeals Council Review

You may still submit new evidence, but it must be:


  • New – not already in your file
  • Material – relevant to your disability
  • Related to the time period before the ALJ decision


If the Appeals Council decides the evidence doesn't meet these standards, it may refuse to consider it.

  • Doctor’s notes showing changes in condition
  • New treatment plans or hospitalizations
  • Mental health evaluations
  • A strong, specific medical opinion from your physician
