When Can You Submit New Evidence?
Reconsideration Stage
At this first level of appeal, the Social Security Administration (SSA) takes a second look at your application. You can submit:
- New medical records
- Updated test results
- Doctor’s opinions or letters
- Any information not included in your initial claim
Hearing with an Administrative Law Judge (ALJ)
This is often the best opportunity to submit new evidence. The ALJ will consider:
- Medical records created after your initial decision
- New diagnoses or worsening symptoms
- A completed Residual Functional Capacity (RFC) form
- Witness statements or vocational expert reports
Appeals Council Review
You may still submit new evidence, but it must be:
- New – not already in your file
- Material – relevant to your disability
- Related to the time period before the ALJ decision
If the Appeals Council decides the evidence doesn't meet these standards, it may refuse to consider it.
